Please read these Terms of Service (“Terms”) carefully before using Marked. By accessing or using Marked, you agree to be bound by these Terms.

  1. 1. Acceptance of Terms

    By creating an account or using Marked, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use Marked.

  2. 2. About Marked

    Marked is an AI-powered improvement platform for essay-based GCSE subjects, starting with English Language and Literature. It gives students structured marking, feedback, and revision tools, with progress visibility for parents on family plans.

  3. 3. Eligibility

    You must be at least 13 years old to use Marked. If you are under 18, you must have permission from a parent or guardian.

  4. 4. Creating and Managing Your Account

    You can sign up with an email and password or with Google. You are responsible for keeping your login details confidential and for all activity that occurs under your account.

  5. 5. Using Marked

    You agree to use Marked only for lawful, educational purposes and in accordance with these Terms and all applicable laws and regulations.

  6. 6. AI-Generated Feedback and Grading

    Marked uses automated technologies, including AI, to produce grades, feedback, and suggestions. These results are intended for educational guidance only and may not always be accurate or equivalent to assessment by a qualified examiner.

  7. 7. User Content

    You retain ownership of the work you submit. By submitting content, you grant Marked a limited licence to process it in order to provide and improve the marking service.

  8. 8. Acceptable Use

    You agree not to misuse Marked. This includes attempting to hack, disrupt, or reverse engineer any part of the platform, or using it for any unlawful or prohibited purpose. Work you submit should be your own.

  9. 9. Subscriptions and Payments

    Some features require a paid subscription. Marked offers Free, Pro, and Family plans; a Family plan links a parent with student profiles in one household, where the parent has read-only visibility. Payments are handled by our payment processor, and by subscribing you agree to pay the fees for the plan you choose.

  10. 10. Free Trials / Free Features

    Marked offers a free tier and may offer trials or promotional features from time to time. We reserve the right to modify or withdraw free features at any time.

  11. 11. Cancellation and Refunds

    You can cancel your subscription at any time; paid access continues until the end of the current billing period. Refunds are handled in accordance with our Refund Policy.

  12. 12. Intellectual Property

    The Marked platform, together with its trademarks, logos, and materials, is owned by or licensed to us and is protected by intellectual property laws.

  13. 13. Third-Party Services

    Marked integrates with third-party services — for example payment processing, email delivery, and AI processing providers. We are not responsible for their content or practices.

  14. 14. Privacy

    Your use of Marked is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

  15. 15. Disclaimers

    Marked is provided “as is” and “as available”, without warranties of any kind, either express or implied — including any warranty that grades or feedback will match those of a human examiner.

  16. 16. Limitation of Liability

    To the maximum extent permitted by law, Marked and its affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the platform.

  17. 17. Indemnification

    You agree to indemnify and hold Marked harmless from any claims, damages, liabilities, losses, and expenses arising from your use of the platform or your violation of these Terms.

  18. 18. Termination

    We may suspend or terminate your account at any time if we believe you have violated these Terms or used Marked in a way that may cause harm to other users or the platform.

  19. 19. Changes to These Terms

    We may update these Terms from time to time. We will notify you of any material changes, and continued use of Marked after changes means you accept the new Terms.

  20. 20. Governing Law

    These Terms are governed by and interpreted in accordance with the laws of the United Kingdom, in which Marked operates, without regard to conflict-of-law principles.
